1) Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of Sam Beyglikli, professionally known as Sam Beklik, a sole trader at Seitenstettengasse 5/37, 1010 Vienna, Austria, e-mail: support@shop.sambeklik.com (hereinafter referred to as “Seller”), apply to contracts concluded between the Seller and a consumer or a trader (hereinafter referred to as “Client”) relating to the goods, digital content and services offered in the Seller’s online shop. The Client’s own terms shall apply only if expressly agreed by the Seller. Individually agreed contractual terms take precedence over these GTC.
1.2 These GTC apply accordingly to the supply of digital content, unless expressly agreed otherwise. Digital content within the meaning of these GTC is data created and supplied in digital form, including downloadable files.
1.3 For contracts regarding the delivery of purchased vouchers, these GTC apply accordingly, unless expressly agreed otherwise. Section 10 concerns only promotional vouchers issued free of charge and does not govern purchased gift vouchers.
1.4 A consumer within the meaning of these GTC is a Client for whom the transaction does not form part of the operation of a business within the meaning of the Austrian Consumer Protection Act (KSchG). Any additional protection granted by mandatory applicable consumer law remains unaffected.
1.5 A trader within the meaning of these GTC is a Client for whom the transaction forms part of the operation of a business. Whether a Client is a consumer or trader is determined by applicable law and the purpose of the transaction, rather than merely by the account type selected in the shop.
2) Conclusion of the Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers by the Seller, but invite the Client to submit a binding offer.
2.2 The Client may submit an offer via the online order form integrated into the Seller’s online shop. After placing the selected products in the virtual basket and completing the ordering process, the Client submits a legally binding offer by activating the final order button. For consumer orders involving payment, this button must clearly indicate an obligation to pay, for example by being labelled “Order with obligation to pay” or another equally unambiguous formulation. The statutory consequences of an inadequately labelled button remain unaffected.
2.3 The Seller may accept the Client’s offer within five calendar days after receiving it,
– by sending an express acceptance or order confirmation by e-mail; receipt by the Client is decisive, or
– by delivering the ordered goods or making the ordered digital content available to the Client, or
– by requesting payment or collecting payment for the order, where the request or collection constitutes acceptance of the order.
If more than one of these events occurs, the contract is concluded when the first acceptance event occurs. An automated acknowledgement that an order has been received, or a payment authorisation without collection, does not by itself constitute acceptance unless it expressly states otherwise. If the Seller does not accept the offer within the stated period, the Client is no longer bound by the offer. Any payment already received for an order that is not accepted shall be refunded without undue delay.
2.4 The Seller stores the contractual information and supplies the Client with a confirmation of the concluded contract, including these GTC and the applicable cancellation information, on a durable medium, normally by e-mail. This confirmation is supplied within a reasonable time after conclusion of the contract and no later than delivery of the goods or before performance of a service begins. For early supply of paid digital content, the confirmation also records any required consent and acknowledgement concerning loss of the right to cancel. If a customer account is available and has been created, order information may also be accessed through that account. The Client can save or print these GTC before submitting an order.
2.5 Before submitting a binding order, the Client can review the order summary and correct input errors by using the editing options, basket controls and navigation functions provided during checkout. Changes can be made until the final order button is activated.
2.6 The language available for conclusion of the contract is English.
2.7 Order processing and communication normally take place by e-mail. The Client should provide an accurate e-mail address and check the relevant inbox and spam folder. This does not release the Seller from statutory information or delivery obligations or alter the legal requirements for receipt of communications.
3) Right to Cancel
3.1 Consumers generally have a statutory right to cancel a distance contract within 14 days without giving a reason, subject to the exceptions provided by applicable law. For goods, the period generally begins when the consumer or a nominated third party other than the carrier receives the goods. For services and digital content not supplied on a physical medium, it generally begins on conclusion of the contract. Special rules apply to separate deliveries, instalments and recurring deliveries.
3.2 Detailed information about exercising the right to cancel, the relevant starting date, returns, refunds and the model cancellation form is provided in the Seller’s cancellation instructions on the Return Policy page and in the contractual confirmation. Cancellation may also be communicated by an unequivocal statement to support@shop.sambeklik.com or to Sam Beyglikli, Seitenstettengasse 5/37, 1010 Vienna, Austria. Use of the model form is not compulsory.
3.3 Consumer cancellation rights are not excluded on the basis of nationality. The mandatory consumer rights applicable to the particular contract remain unaffected.
3.4 The statutory right to cancel does not apply to goods genuinely made to the Client’s specifications or clearly personalised, where the relevant statutory exception applies. Producing a standard product only after receiving an order does not, by itself, make it personalised.
3.5 For paid digital content not supplied on a physical medium, the right to cancel is lost after supply has begun only if all statutory conditions have been met. These include the consumer’s prior express consent to supply before the cancellation period expires, acknowledgement that beginning supply causes loss of the right to cancel, and the Seller’s provision of the required contract confirmation on a durable medium. Merely accepting these GTC does not replace that express consent and acknowledgement.
3.6 For eligible contracts concluded through the online shop, the Seller shall make an online withdrawal function available throughout the applicable cancellation period in accordance with Section 13a of the Austrian Distance and Off-Premises Contracts Act (FAGG). It shall be prominently and easily accessible and clearly labelled, for example “Withdraw from contract”. The consumer shall be able to identify themselves and the contract and provide an electronic address for acknowledgement, then submit the declaration through a clearly labelled confirmation function, for example “Confirm withdrawal”. The Seller shall acknowledge receipt without undue delay on a durable medium, including the declaration and its receipt date and time. Other lawful methods of cancellation remain available.
4) Prices and Payment Conditions
4.1 Prices displayed in the online shop are total prices in the stated currency and include any applicable VAT. If a VAT exemption applies to a particular sale, the applicable tax treatment is indicated with the offer or during checkout. Delivery charges and any other charges payable to the Seller are disclosed before the Client submits the order. Optional additional charges require the Client’s express agreement.
4.2 Payment may be made using the methods displayed as available during checkout. The applicable payment timing and any payment-provider requirements are disclosed before the order is submitted.
4.3 Deliveries outside the European Union may be subject to import duties, import taxes or customs-clearance charges imposed by the destination country or relevant service providers. These are payable by the Client where they are not included in the agreed price. The Seller informs the Client before ordering where such additional charges may arise. The Client’s bank or payment provider may also charge currency-conversion or international-transfer fees under its own agreement with the Client.
4.4 Credit card payment via Stripe
Where credit card payment through Stripe is offered and selected, payment is processed through Stripe. The payment amount and timing are displayed during checkout. Any payment authorisation or authentication requirements are governed by the applicable payment arrangements. The Client’s statutory rights against the Seller are unaffected.
4.5 Where a payment method offered through Klarna is available and selected, payment is processed through Klarna. The applicable payment schedule, eligibility requirements and any separate financing terms are presented before the Client commits to that payment method. The Client’s statutory rights against the Seller are unaffected.
5) Shipment and Delivery Conditions
5.1 Goods are delivered within the delivery area indicated in the shop to the address provided by the Client, unless otherwise agreed. Delivery restrictions, charges and the applicable delivery period are disclosed before the order is submitted. For consumer goods, unless another delivery period has been agreed, the Seller shall deliver without undue delay and no later than 30 days after conclusion of the contract. Statutory rights relating to late delivery remain unaffected.
5.2 If delivery fails because of circumstances for which the Client is responsible, the Seller may seek reimbursement only of reasonable, necessary additional costs recoverable under applicable law. No such charge is imposed merely because a consumer lawfully exercises the right to cancel, or where delivery fails for reasons for which the Client is not responsible. Return costs following cancellation are governed by the cancellation instructions and applicable law.
5.3 Personal collection is not available unless expressly agreed with the Seller.
5.4 Digital content is supplied electronically through the method described for the relevant product, including:
– download, or
– direct access through the Seller’s website.
Digital content shall be supplied without undue delay after conclusion of the contract unless another supply time is agreed. Any applicable advance-payment condition and requirements for early supply during the cancellation period are disclosed before ordering. The product information describes relevant functionality, compatibility, interoperability and technical requirements.
5.5 If a product becomes unavailable after conclusion of the contract, the Seller shall inform the Client without undue delay. Unavailability does not automatically release the Seller from contractual obligations. Any termination or other remedy is governed by applicable law. If the contract is lawfully terminated, payments for the affected supply shall be refunded without undue delay.
5.6 For consumers, the risk of loss or damage in transit passes only when the goods are delivered to the consumer or a nominated third party other than the carrier. The statutory exception applies where the consumer independently commissions a carrier that was not offered by the Seller. Selecting a delivery option offered by the Seller does not transfer transit risk earlier.
6) Granting Rights of Use for Digital Content
6.1 Unless the relevant product description grants different rights, the Seller grants the Client a non-exclusive licence, unlimited in territory and duration, to use the supplied digital content for private purposes. Any permission for professional or commercial use is governed by the licence stated for the relevant product before purchase. Copyright ownership is not transferred.
6.2 The Client may not distribute, resell, sublicense or make the supplied digital content available to third parties, except as permitted by the applicable product licence, the Seller’s express permission or mandatory law. Statutory rights and copyright exceptions remain unaffected.
6.3 The contractual licence becomes effective when the agreed price has been paid in full. The Seller may expressly permit provisional use before that time. This condition does not restrict statutory cancellation, refund or warranty rights.
6.4 If the contract is lawfully cancelled or terminated and the right to use the digital content consequently ends, the Client shall cease using it and making it available to others, subject to applicable law.
7) Reservation of Proprietary Rights
Where physical goods are delivered before full payment, the Seller retains ownership until the agreed purchase price has been paid in full. This reservation does not alter the statutory allocation of transit risk or restrict the Client’s mandatory rights.
8) Warranty
8.1 The statutory Austrian warranty provisions apply. For consumers, these include the Consumer Warranty Act (VGG), where applicable, and the relevant provisions of the Austrian Civil Code (ABGB) and Consumer Protection Act (KSchG). These GTC do not exclude or reduce mandatory consumer warranty rights.
8.2 For consumer goods, the Seller is generally responsible for defects present at delivery that become apparent within two years after delivery. Different statutory rules apply to legal defects and goods with continuously supplied digital elements. Statutory presumptions, limitation periods and extensions remain unaffected.
8.3 Used goods are also covered by statutory warranty rights. These GTC do not shorten the consumer warranty period for used goods. Any legally permitted shortening requires a separate, individually negotiated agreement satisfying the applicable statutory conditions.
8.4 Consumers may seek repair or replacement in accordance with the statutory rules and, where the legal conditions are met, a price reduction or termination of the contract. Remedies must be provided within a reasonable time and without costs or significant inconvenience. For consumer goods contracts concluded from 1 October 2026, the warranty period is extended once by one year where a repair is carried out under Section 12(2) VGG to restore conformity. Before providing the remedy, the Seller shall inform the consumer about the statutory choice between repair and replacement and the possible extension.
8.5 Digital content and goods with digital elements are subject to the applicable statutory conformity and update obligations. For digital content supplied once or in separate instances, the Seller is generally responsible for defects present at supply that become apparent within two years. For continuous digital supply, the applicable supply-period rules apply. Required updates shall be supplied for the period prescribed by law. A contractual licence duration does not, by itself, create a promise of indefinite updates or hosting.
8.6 For traders, statutory Austrian warranty provisions apply unless a lawful individual agreement provides otherwise. Where the transaction is a business transaction for both parties, the inspection and defect-notification obligations under Section 377 of the Austrian Business Code (UGB) apply to the extent legally applicable. The statutory exceptions to those obligations remain unaffected.
8.7 Consumers are asked to report visible transport damage promptly to the Seller and, where practicable, to the carrier. Failure to do so does not remove or reduce their statutory warranty or other mandatory rights. Warranty inquiries may be sent to support@shop.sambeklik.com.
8.8 Statutory damages claims and any separately granted commercial guarantees remain unaffected. The Seller does not exclude responsibility for defective digital supply merely because a telecommunications or other service provider is involved. Liability is determined by applicable law and the circumstances of the defect.
9) Special Conditions for the Processing of Goods According to Client’s Specification
9.1 Where customised processing is agreed, the Client shall supply the texts, images, graphics or other materials reasonably required in the agreed formats and specifications. The Client grants the Seller the rights necessary to carry out the agreed order and confirms that they are entitled to authorise that use. The Client shall not knowingly supply material that infringes copyright, trademark, privacy, image or other third-party rights.
9.2 The Client is responsible for losses resulting from a culpable breach of these obligations only to the extent provided by applicable law. Any obligation to reimburse third-party claims or reasonable defence costs is limited accordingly and does not cover loss attributable to the Seller’s own fault or use outside the agreed authorisation. Where a claim arises, the parties shall reasonably cooperate in clarifying the facts and defending the claim. Mandatory consumer protections remain unaffected.
9.3 The Seller may refuse an order before acceptance if the supplied material is unlawful or infringes third-party rights. Where an issue is discovered after acceptance, suspension or termination is governed by applicable law. The Seller shall inform the Client and, where legally appropriate, allow an opportunity to provide lawful replacement material. Any refund or payment consequences are determined by applicable law.
10) Redemption of Campaign Vouchers
10.1 Vouchers issued by the Seller free of charge for a specified promotional period (hereinafter referred to as “campaign vouchers”) may be redeemed only in the Seller’s online shop and within the validity period stated for the campaign. This section does not apply to purchased gift vouchers.
10.2 Individual products may be excluded where the exclusion is clearly stated in the campaign conditions before redemption.
10.3 Several campaign vouchers may be redeemed for an order unless the relevant campaign conditions clearly state otherwise before the order is submitted.
10.4 Where a campaign voucher has a fixed discount value, the eligible order value must be at least that amount unless the campaign conditions provide otherwise. Unused promotional value is not refundable in cash.
10.5 If the campaign voucher does not cover the payable order amount, the Client may pay the difference using an available payment method.
10.6 Campaign vouchers cannot be exchanged for cash and do not bear interest.
10.7 If the Client lawfully cancels a purchase, the refund is calculated from the amount actually paid for the cancelled products in accordance with applicable law. No cash refund is due for a discount supplied free of charge. The use of a campaign voucher does not restrict statutory cancellation, refund or warranty rights.
10.8 Where a campaign voucher is expressly issued to a named person and described as non-transferable, only that person may redeem it. Other campaign vouchers may be used in accordance with their stated conditions. The Seller may reasonably verify entitlement to a personalised voucher.
11) Applicable Law
The law of the Republic of Austria applies to contractual relationships between the parties, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law does not deprive them of protection afforded by mandatory provisions of the law that would apply in the absence of this choice, including the law of their habitual residence where the relevant conflict-of-laws rules provide for it. Mandatory consumer jurisdiction rights remain unaffected.
12) Alternative Dispute Resolution
12.1 Questions and complaints may be sent to support@shop.sambeklik.com or to Sam Beyglikli, Seitenstettengasse 5/37, 1010 Vienna, Austria.
12.2 The Seller does not voluntarily participate in proceedings before a consumer alternative dispute-resolution body. Any statutory participation obligations remain unaffected. Where a consumer complaint cannot be resolved directly, the Seller shall provide the information about the relevant alternative dispute-resolution body and the Seller’s participation position required by Section 19 of the Austrian Alternative Dispute Resolution Act (AStG) on a durable medium.
