Instructions for Withdrawal & Withdrawal Form

This policy applies to consumers purchasing through our online shop. A consumer is a person entering into the transaction for purposes outside their business. Statutory withdrawal rights and rights relating to defective goods or digital content are not restricted by a “final sale” description.

A. Instructions for Withdrawal

Right to Withdraw

You have the right to withdraw from an eligible distance contract within 14 days without giving any reason.

For physical goods, the withdrawal period expires 14 days after the day on which you, or a third party nominated by you other than the carrier, acquire physical possession of the goods. If several goods ordered in one order are delivered separately, the period begins when you or that third party receive the last item. For goods delivered in several lots or pieces, the period begins on receipt of the last lot or piece.

Our Limited Edition and Masterprint Edition prints are standard designs. Their limited availability, edition number or production after an order does not, by itself, exclude the statutory right of withdrawal. Starting production does not shorten that right.

For digital content supplied without a physical medium, including downloadable preset packs, the withdrawal period expires 14 days after the day the contract is concluded, unless the right has ended earlier under the conditions explained below.

To exercise your right of withdrawal, notify Sam Beyglikli, Seitenstettengasse 5/37, 1010 Vienna, Austria, E-Mail: support@shop.sambeklik.com, of your decision by a clear statement, for example by e-mail or a letter sent by post. You may use the model form below, but it is not obligatory. You may also send a clear statement through our website contact form. Selecting a particular contact-form category or obtaining our prior approval is not a condition for a valid withdrawal.

To meet the withdrawal deadline, it is sufficient to send your statement before the withdrawal period expires. You may also notify us before delivery.

For online contracts covered by § 13a of the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG), you are additionally entitled to use an online withdrawal function throughout the applicable withdrawal period. That function must allow you to identify the contract, confirm withdrawal and receive an acknowledgement on a durable medium containing the statement and its receipt date and time. This additional route does not restrict your right to withdraw by e-mail or another clear statement.

Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs, except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us. Reimbursement will be made without undue delay and no later than 14 days after the day on which we receive your statement of withdrawal.

We will use the same means of payment that you used for the original transaction unless you expressly agree otherwise. You will not incur fees for the reimbursement. Reimbursement is not conditional on our approval of a valid statutory withdrawal.

For physical goods, unless we have offered to collect them, we may withhold reimbursement until we receive the goods back or you supply evidence of having sent them back, whichever occurs first.

Send the goods back to Sam Beyglikli, Seitenstettengasse 5/37, 1010 Vienna, Austria, without undue delay and no later than 14 days after the day on which you communicate your withdrawal. The deadline is met if you send the goods before that period expires.

You bear the direct cost of returning the goods when exercising your statutory right of withdrawal, provided we informed you of this obligation before the contract was concluded. There is no separate restocking or cancellation fee.

You are liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, subject to the statutory conditions. Inspection does not, by itself, make a print non-returnable. Any deduction must reflect an actual, legally recoverable diminished value.

If you validly withdraw from a digital-content contract, you must stop using the digital content and must not make it available to anyone else. No charge is payable for digital content already supplied where the statutory right of withdrawal remains available and is exercised.

Digital Content and Early Loss of the Right of Withdrawal

For paid digital content supplied without a physical medium, including preset packs, the withdrawal right ends when we begin supplying the content only if all of the following statutory conditions are met:

1. Before supply begins, you expressly consent to supply starting before the end of the 14-day withdrawal period.

2. You acknowledge that you lose your right of withdrawal when supply begins.

3. We provide the required contract confirmation on a durable medium, such as e-mail, including confirmation of your consent and acknowledgement.

A purchase, order confirmation, general acceptance of our terms or the fact that a file can be downloaded does not, by itself, fulfil these requirements. Where all requirements are met and supply has begun, there is no statutory change-of-mind withdrawal right. Where they are not met, the applicable statutory withdrawal right is not removed merely because the content has been downloaded or used.

Defective Goods, Digital Content and Other Statutory Rights

This policy concerns withdrawal without giving a reason. It does not exclude or restrict your statutory rights concerning defective, damaged, incorrect or non-conforming goods or digital content. These rights also apply to limited edition prints and digital products for which the change-of-mind withdrawal right has validly ended.

If there is a problem with your order, contact support@shop.sambeklik.com with the order details and a description of the issue. Photographs can help us investigate physical damage where reasonably available. The availability of a particular remedy, such as repair, replacement, a price reduction or termination and reimbursement, follows the applicable statutory conditions. Costs that we must bear for a statutory remedy are not transferred to you by the change-of-mind return-cost clause above.

General Information on Returning Goods

1. Please protect the goods against damage during return transport. Where possible, use the original packaging and include supplied accessories. If the original packaging is unavailable, use suitable protective packaging.

2. Please use a suitable return service and retain proof of dispatch. Tracking is recommended for valuable prints. Original packaging, tracking and advance authorisation are not conditions for exercising the statutory right of withdrawal.

3. Please pay return postage where you are responsible for the direct return cost. For a defective or incorrect item, contact us to arrange the appropriate statutory remedy and return process.
