BLUEGRADE Terms and Conditions

Effective date: July 3, 2026

These Terms and Conditions (“Terms”) apply to the BLUEGRADE mobile application (the “App”), operated by Sam Beyglikli (“we”, “us”, or “our”). By downloading, purchasing, or using BLUEGRADE, you agree to these Terms.

Your license to use the App is also governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”). These Terms supplement the Apple Standard EULA. If there is a conflict concerning your license to the App, the Apple Standard EULA controls.

1. What BLUEGRADE Does

BLUEGRADE provides photo editing tools, presets, color grading, crop controls, grain effects, recommendations, and export features. Features may vary by device, operating system, App version, purchase status, and region.

2. License and Acceptable Use

Subject to these Terms and the Apple Standard EULA, you receive a limited, personal, non-exclusive, non-transferable, and revocable license to use BLUEGRADE on compatible Apple devices you own or control, as permitted by Apple.

You may not:

copy, redistribute, resell, sublicense, or commercially exploit the App, its presets, LUTs, designs, or other included content;
extract, reproduce, publish, or distribute presets, filters, LUT data, source code, or protected assets outside the normal use of the App;
reverse engineer, bypass access restrictions, interfere with security, or attempt unauthorized access, except where applicable law expressly permits it;
use the App unlawfully or in a way that infringes another person’s rights.
3. Your Photos and Content

You retain ownership of photos and other content you import into or export from BLUEGRADE. You confirm that you have the necessary rights and permissions to use that content. We do not claim ownership of your photos merely because you edit them with the App.

You are responsible for your exported content and for how and where you publish or share it.

4. Presets and Editing Results

Editing results can vary based on the source image, color profile, exposure, device display, file format, operating system, and export settings. Preview rendering may use an optimized image for performance, while supported exports may be rendered at a higher resolution.

BLUEGRADE does not guarantee identical results to Adobe Lightroom, Adobe Camera Raw, VSCO, or any other product. Adobe, Lightroom, Camera Raw, VSCO, and other third-party names and marks belong to their respective owners. BLUEGRADE is not affiliated with, endorsed by, or sponsored by those companies.

5. Free and Premium Features

Some tools or presets may be free, while others may require a subscription or one-time purchase. The App clearly identifies paid features before purchase. We may add, modify, replace, or discontinue features and content, subject to applicable law and any commitments stated in the product description at the time of purchase.

6. Subscriptions

Where a subscription is offered:

payment is charged to your Apple Account when you confirm the purchase;
the subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period;
your Apple Account may be charged for renewal within 24 hours before the end of the current period;
you can manage or cancel the subscription in your Apple Account subscription settings;
the price, billing period, and any introductory offer shown by Apple at purchase are the terms that apply to that transaction.

Deleting the App does not automatically cancel an active subscription.

7. One-Time Purchases

Where a lifetime or other one-time purchase is offered, it grants access to the features described at the time of purchase for the supported lifetime of the App. It does not transfer ownership of BLUEGRADE, its presets, intellectual property, or future products. Unless expressly stated at purchase, it does not guarantee every future feature or content pack.

8. Billing, Restore Purchases, and Refunds

Apple processes all App Store payments. You can use Restore Purchases in the App where available. Refund requests and billing disputes are handled by Apple under Apple’s applicable policies. We do not receive your complete payment card details.

9. App Availability and Updates

We aim to keep BLUEGRADE reliable, but uninterrupted or error-free operation is not guaranteed. The App may require updates to remain compatible with Apple devices or operating systems. We may perform maintenance, change remote content, or discontinue parts of the service when reasonably necessary.

10. Third-Party Services

BLUEGRADE uses Apple services for distribution, purchases, photo selection, and sharing, and may retrieve Explore content from sambeklik.com. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services beyond what applicable law requires.

11. Intellectual Property

BLUEGRADE, including its software, visual design, branding, presets, LUTs, graphics, text, and included content, is owned by or licensed to Sam Beyglikli and is protected by applicable intellectual property laws. No rights are granted except the limited right to use the App under these Terms and the Apple Standard EULA.

12. Disclaimers

To the fullest extent permitted by law, BLUEGRADE is provided “as is” and “as available” without warranties beyond those that cannot legally be excluded. Photo editing is subjective, and we do not warrant that every preset or recommendation will produce a particular artistic or commercial result.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot be excluded under the laws applicable to you.

13. Limitation of Liability

To the fullest extent permitted by law, Sam Beyglikli will not be liable for indirect, incidental, special, consequential, or punitive losses, or for lost profits, data, opportunities, or business arising from use of the App. Our total liability will not exceed the amount you paid for BLUEGRADE during the 12 months before the event giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where such exclusions are prohibited.

14. Suspension and Termination

We may suspend or terminate access to the App if you materially violate these Terms, misuse paid content, threaten service security, or where required by law. You may stop using the App at any time. Provisions concerning intellectual property, disclaimers, liability, and disputes survive termination where appropriate.

15. Changes to These Terms

We may update these Terms to reflect changes to BLUEGRADE, business practices, or legal requirements. The updated Terms will be posted on this page with a revised effective date. Material changes will apply prospectively where required by law.

16. Governing Law

These Terms are governed by the laws applicable at our place of establishment, without prejudice to mandatory consumer protections and jurisdiction rights available in your country of residence. The Apple Standard EULA also contains terms governing the licensed application relationship.

17. Apple

Apple is not responsible for BLUEGRADE or its content, maintenance, support, or claims, except as stated in the Apple Standard EULA or required by law. Apple and its subsidiaries are third-party beneficiaries of the license terms and may enforce them as permitted by the Apple Standard EULA.
